A. If you are depositing funds to discharge a mechanic’s lien, you must complete the required form which can be found here and the instructions here and provide a post-paid return envelope. Mail the completed form, the post-paid envelope and certified funds for the amount required to be deposited to Attn: Court Actions, 310 Center Drive, Riverhead, New York 11901. The amount required to be deposited is the amount of the lien plus 9% interest from the date the lien was filed until the date of deposit of the funds plus the required $3 fee.
If you are seeking to discharge the mechanic’s lien through a surety bond prior to the commencement of an action to foreclose the lien, you must submit the original bond and all supporting documents to the Suffolk County Clerk at Attn: Judgments and Liens Department, 310 Center Drive, Riverhead, New York 11901. The amount of the bond is 110% of the amount of the lien claimed.
