(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that Juan Chuquimarca Guzman, 20, of Shelter Island, was indicted for Promoting and Possessing a Sexual Performance by a Child, for allegedly uploading videos and images of child sexual abuse to a cloud service.
“The exploitation of children is among the most serious crimes we prosecute. Uploading these materials encourages further violent sexual assaults of children,” said District Attorney Tierney. “Anyone engaging in these activities will face serious consequences. We are committed to protecting the most vulnerable members of our community and will continue working alongside our law enforcement partners to bring offenders to justice.”
According to the investigation, in August 2024, the New York State Police received a tip from the National Center for Missing and Exploited Children regarding an individual that was allegedly uploading child sexual abuse material to a cloud service. Investigators from the New York State Police responded to the defendant’s home and spoke with Guzman, who consented to a download of his phone.
Upon digital forensic analysis, child sexual abuse material was allegedly discovered on Guzman’s phone, and it was revealed that Guzman had allegedly uploaded over 4,000 videos and images of child sexual abuse to a cloud service. Further analysis revealed that Guzman had allegedly exchanged some of the videos and images with other users of a messaging application.
On November 18, 2024, Guzman was arraigned on the indictment before Acting Supreme Court Justice Karen M. Wilutis, for 21 counts of Promoting a Sexual Performance by a Child, Class D felonies, and 20 counts of Possessing a Sexual Performance by a Child, Class E felonies.
Promoting a Sexual Performance by a Child is a bail-eligible offense, meaning that prosecutors are permitted to request that a defendant be held on bail. Here, in response to the District Attorney’s request, Justice Wilutis ordered Guzman held on $1,000,000 cash, $2,000,000 bond or $10,000,000 partially secured bond. Guzman is being represented by Kevin Gilvary, Esq. His next court date is December 12, 2024.
This case is being prosecuted by Assistant District Attorney Zachary Kelly of the Child Abuse and Domestic Violence Bureau, and the investigation was conducted by Investigator Ryan Delaney of the New York State Police.
