(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that Jose Osorio pleaded guilty to Burglary in the Second Degree for a residential burglary that he committed in the Babylon area earlier this year. Osorio, who was on parole at the time of the crime, is a persistent violent felony offender and thus faces 16 years to life in prison.
“This defendant admitted to violating the sanctity of the victim’s home and stealing items so he could sell them for profit,” said District Attorney Tierney. “This disregard for other people’s homes and property is unconscionable. This case demonstrates our continuing commitment to arrest, prosecute and seek significant prison sentences for repeat offenders such as this defendant.”
On May 4, 2022, Osorio broke into a home in Babylon through a basement window and stole numerous items. One of the items he stole - a key fob for a vehicle - was equipped with an Apple air tag, which allowed the Suffolk County Police Department to track its location to the vicinity of the defendant’s address. After the investigation identified Osorio as a suspect, he was arrested at a local Pawn Shop, where he was attempting to sell proceeds of the burglary.
Subsequent to his arrest, members of the Suffolk County Police Department recovered additional proceeds during a search of Osorio’s home. The defendant also made admissions to the crime.
Osorio’s criminal history includes two prior violent felony convictions. In 1995, he was convicted of Burglary in the Second Degree, for which he was sentenced to 4 to 8 years in prison, and in 2003, he was convicted of Attempted Burglary in the Second Degree, for which he was sentenced to 12 years to life in prison. The defendant was released to parole supervision in 2019.
Osorio pleaded guilty on Wednesday, November 30, 2022 before Supreme Court Justice, the Honorable Timothy P. Mazzei, to Burglary in the Second Degree. He is scheduled for sentencing on January 30, 2023. Osorio was represented by the Legal Aid Society.
This case is being prosecuted by Assistant District Attorney William L. Richards III of the Major Crime Bureau.
