(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that Elmer Martinez, 44, of Central Islip, pleaded guilty to Course of Sexual Conduct Against a Child in the First Degree, for repeated acts of sexual abuse, including sexual intercourse, with a child beginning when the victim was 10 years old.
“Innocent children should never once have to experience the pain and trauma of sexual abuse, let alone for years,” said District Attorney Tierney. “This child’s bravery in coming forward gave my prosecutors the ability to bring this defendant to justice. Thankfully, as a result of this guilty plea, this child will not have to be subject to trial and cross-examination.”
According to the investigation and the defendant’s admissions during his guilty plea allocution, in the fall of 2014, when the victim was 10 years old, Martinez began touching the victims’ intimate parts. As time went on, Martinez’s conduct escalated to acts of sexual intercourse, including oral and anal sexual conduct. Martinez threatened the child in an attempt to prevent her from disclosing the abuse. The defendant continued exploiting and abusing the victim until March 2020. A few months later, the victim reported the abuse to police despite the fear she felt as a result of Martinez’s threats.
On March 17, 2023, Martinez pleaded guilty before County Court Judge, the Honorable Judge Karen M. Wilutis, to Course of Sexual Conduct Against a Child in the First Degree, a Class B violent felony. He is due back in court on May 5, 2023, when he will be sentenced up to 10 years in prison followed by 10 years of post-release supervision. Martinez is being represented by Christopher Gioe, Esq.
This case is being prosecuted by Assistant District Attorney Tara Laterza of the Child Abuse and Domestic Violence Bureau.
