BAYPORT MEN INDICTED FOR ALLEGEDLY SELLING COUNTERFEIT OXYCODONE PILLS THAT CONTAINED FENTANYL THAT LED TO AN OVERDOSE DEATH

(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that Anthony Trimboli, 34, of Bayport, was indicted for allegedly selling fentanyl-laced pills, including to a 40-year-old woman which caused her to overdose and die. Trimboli’s alleged supplier, Matthew Familia, 40, of Bayport, was also indicted for illegally possessing a cache of counterfeit pills, drugs, ammunition feeding devices, and an unregistered assault weapon.

“We will not sit back and continue to watch as unsuspecting people in Suffolk County die from ingesting fentanyl-laced counterfeit pills. My Office will continue to investigate these tragic deaths and work tirelessly to bring the dealers and their suppliers of these dangerous pills to justice,” said District Attorney Tierney. “I continue to urge New York State legislators to amend the current laws to increase the penalty for dealers who cause these preventable deaths and allow us to ask for bail on those selling deadly fentanyl.”

According to the investigation, on January 31, 2023, Trimboli allegedly sold a 33-year-old man counterfeit oxycodone pills that contained fentanyl out of his Bayport home.After ingesting the pill that Trimboli allegedly sold him, the victim suffered an immediate overdose. Although the victim survived, he suffered permanent physical impairment.

On February 4, 2023, Trimboli allegedly sold counterfeit oxycodone pills containing fentanyl and counterfeit Xanax pills out of his home to a 40-year-old Centereach woman. That victim ingested those pills and suffered an immediate overdose. The victim was treated at Stony Brook University Hospital, where she was found to have a lethal level of fentanyl in her blood. As a result, she later died at the hospital, never regaining consciousness.

The Suffolk County Police Department’s Narcotics Section conducted a long-term investigation into Trimboli, that resulted in Trimboli allegedly selling counterfeit oxycodone and Xanax pills containing illicit substances such as fentanyl, cocaine, and clonazolam to undercover detectives. While clonazolam is not considered a “controlled substance” in New York State, the Drug Enforcement Administration (DEA) has labeled it as an imminent hazard to public safety.

On July 27, 2023, a search warrant was executed at a residence in Bayport that Trimboli and Familia shared. During the search, Trimboli was found in possession of a cellular phone he allegedly used to distribute illicit substances. Familia, who is alleged to have supplied Trimboli with cocaine and counterfeit pills, was allegedly found in possession of a cache of counterfeit pills, cocaine, ketamine, packaging materials, scales, three high-capacity ammunition feeding devices, and an unregistered assault weapon. 

On August 25, 2023, Trimboli was arraigned on the indictment by the Honorable Richard I. Horowitz, for the following charges:

• Four counts of Criminal Sale of Controlled Substance in the Third Degree, Class B felonies;
• Four counts of Criminal Possession of a Controlled Substance in the Third Degree, Class B felonies;
• Three counts of Attempted Criminal Sale of a Controlled Substance in the Fifth Degree, Class E felonies; and
• Three counts of Attempted Criminal Possession of a Controlled Substance in the Fifth Degree, Class E felonies.

Judge Horowitz ordered Trimboli held on $300,000 cash, $600,000 bond, or $3 million partially secured bond. Trimboli is due back in court on September 28, 2023, and is being represented by Katherine Fernandez, Esq.   

On August 25, 2023, Familia was arraigned on the indictment by Judge Horowitz, for the following charges:

• One count of Criminal Possession of a Controlled Substance in the Second Degree, a Class A-II felony;
• Four counts of Criminal Possession of a Weapon in the Third Degree, Class D violent felonies;
• Three counts of Criminal Possession of a Controlled Substance in the Third Degree, Class B felonies;
• Two counts of Criminal Possession of a Controlled Substance in the Fifth Degree, Class D felonies;
• One count of Attempted Criminal Possession of a Controlled Substance in the Fifth Degree, a Class E felony; and
• Two counts of Criminal Use of Drug Paraphernalia in the Second Degree, Class A misdemeanors.

Judge Horowitz ordered Familia held on $200,000 cash, $400,000 bond or $2 million partially secured bond. Familia is due back in court on September 28, 2023, and is being represented by Ramond Doyle, Esq. 

This case is being prosecuted by Assistant District Attorneys Nicole Felice and Raquel Tisi of the Narcotics Bureau, with investigative assistance from Detective Paul Ruotolo of the Suffolk County Police Department’s Narcotics Section.
