(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced the indictment of Kevin Rosas Daqui, 25, who is accused of driving at a high rate of speed while intoxicated, striking the back of a disabled vehicle, and causing traumatic amputations to both legs of the victim, who was crushed between the vehicles.
“The victim was tending to her disabled vehicle when this defendant, while allegedly intoxicated and driving recklessly, crashed into the victim and her car, causing injuries so severe that both of her legs had to be amputated,” said District Attorney Tierney. “His passengers were also severely injured in the crash. In the blink of an eye, this alleged reckless behavior has forever altered the lives of the victims.”
Rosas Daqui is charged with:
Three counts of Aggravated Vehicular Assault, a Class C felony;
Two counts of Assault in the Second Degree, a Class D violent felony;
Three counts of Vehicular Assault in the First Degree, a Class D felony;
Two counts of Vehicular Assault in the Second Degree, a Class E felony;
One count of Assault in the Third Degree, a Class A misdemeanor;
One count of Aggravated Driving While Intoxicated, a Class U misdemeanor;
Two counts of Driving While Intoxicated, a Class U misdemeanor;
One count of Reckless Endangerment in the Second Degree, a Class A misdemeanor; and
One count of Reckless Driving, a Class U misdemeanor.
According to court documents, on November 5, 2022, at approximately 12:37 a.m., Rosas Daqui was driving to Brentwood with his passengers after spending the evening at the Marine Corps Ball in Westbury. The defendant was operating a 2012 Honda Civic at a high rate of speed, heading southbound on the Sagtikos Parkway near Crooked Hill Road, when he struck a disabled vehicle in the right lane. The victim was standing near the rear of her vehicle, attempting to remove a spare tire from her trunk, when she was struck by the defendant’s vehicle. The impact caused traumatic and instant amputation to both of the victim’s lower legs. The victim was treated by an off-duty Suffolk County Police officer and his wife shortly after the crash. The couple applied belts as tourniquets to both legs in a successful attempt to save her from bleeding to death. The good Samaritans stayed with the victim until medical personnel and law enforcement arrived on the scene to assist. The victim was transported to Stony Brook University Hospital where she underwent life-saving emergency surgery to close the wounds she sustained as a result of the double amputation.
The defendant’s two passengers also sustained injuries as a result of the crash. One, who is a member of the United States Marine Corps, was transported to South Shore University Hospital where he underwent emergency surgery for skull and facial fractures. He remained in the hospital for 18 days. The other was also transported to South Shore University Hospital, where she was diagnosed with a lower spine fracture.
A toxicology report revealed that Rosas Daqui had a blood alcohol content of .22%, more than twice the legal limit.
Today, Supreme Court Justice, the Honorable Timothy P. Mazzei ordered the defendant released in his own recognizance and suspended his driver’s license. The District Attorney’s Office had requested that bail be set at $50,000 cash, $100,000 bond or $500,000 partially secured bond. The defendant is due back in court on February 22, 2023.
This case is being prosecuted by Assistant District Attorney Maggie Bopp of the Vehicular Crime Bureau.
