(SUFFOLK COUNTY, N.Y.) – Suffolk County District Attorney Raymond A. Tierney today announced that Ismael Rodriguez-Rosado, 29, of East Islip, was sentenced to 17 years to life in prison for Murder in the Second Degree, after shooting 31-year-old German Ariel Montes De Oca Ramirez, of Bay Shore, to death outside of a restaurant in August 2021.
“This defendant shot Mr. Montes De Oca Ramirez in cold blood and without remorse, said District Attorney Tierney.” “As District Attorney I will continue to do my part by prosecuting criminals as well as keeping these deadly weapons off the streets of Suffolk County.
According to the investigation, on August 2, 2021, at approximately 1:06 a.m., Rodriguez-Rosado and Montes De Oca Ramirez were both outside of Mi Nuevo Encanto Restaurant and Bar in Central Islip when a verbal argument between the two began. Rodriguez-Rosado pulled out a 9 mm pistol and shot Montes De Oca Ramirez four times, killing him. A witness called 911 and stated that shots were fired outside of the bar, and that they saw a red color Ford Edge SUV traveling southbound on Carleton Avenue away from the scene.
Rodriguez-Rosado drove to a gas station parking lot at the corner of Union Boulevard and Saxon Avenue in Bay Shore. When undercover police officers spotted the red SUV, they pulled into the gas station parking lot and attempted to block the defendant’s vehicle from leaving. Rodriguez-Rosado struck the undercover police vehicle as he escaped from the gas station.
The defendant then fled northbound on Saxon Avenue while the undercover police vehicle followed. The pursuit continued onto southbound Commack Road where Rodriguez-Rosado began to drive erratically down the center of the road toward oncoming police vehicles. The undercover police vehicle then struck Rodriguez-Rosado’s vehicle on the rear driver’s side wheel causing it to spin and come to a stop. Rodriguez-Rosado was then placed under arrest.
The murder weapon was located that same evening by members of the K-9 Unit of the Suffolk County Police Department approximately one mile away from where Rodriguez-Rosado was apprehended. Detectives recovered multiple surveillance video recordings from around the restaurant that captured the homicide as it was occurring.
Prior to this case, Rodriguez-Rosado was convicted of Attempted Robbery in the First Degree in 2016 and sentenced to two years in prison followed by three years of post-release supervision.
On June 5, 2023, Rodriguez-Rosado pleaded guilty before County Court Judge, the Honorable Stephen Braslow, to the charges of Murder in the Second Degree, a Class A felony, and two counts of Criminal Possession of a Weapon in the Second Degree, a Class C felony. On October 20, 2023, Judge Braslow sentenced Rodriguez-Rosado to 17 years to life in prison. He is being represented by George Duncan, Esq.
This case is being prosecuted by Assistant District Attorney Eric S. Aboulafia of the Homicide Bureau, with investigative assistance from Suffolk County Police Department Detective T. Michael Palumbo of the Homicide Squad.
