Town of Brookhaven

Should the Town Code of the Town of Brookhaven be amended to establish term limits of three (3) four-year terms for elected officials, and amend the length of term of office from two (2) years to four (4) years for all elected officials, commencing January 1, 2020?

Text Amendment. Chapter 20 entitled “Departments and Bureaus” is hereby amended as follows:

CHAPTER 20. DEPARTMENTS AND BUREAUS

Article IV Office of the Supervisor

§ 20-14 Establishment.

D.  Term of Office and Term Limits

  1. The Supervisor’s term of office, as elected by a majority of Town of Brookhaven voters, shall be for four (4) years until the next required election date.
  2.  The Supervisor may serve up to three four-year terms regardless of whether said terms are served consecutively or non-consecutively.

Article XI:  Office of the Town Council

§ 20-62 Term of Office and Term Limits  

  1. A Member of the Town Council’s term of office, as elected by a majority of the Town of Brookhaven voters within each respective ward, shall be for four (4) years until the next required election date.
  2. A Member of the Town Council may serve up to three four-year terms regardless of whether said terms are served consecutively or non-consecutively.

Article XIII: Office of the Superintendent of Highways

§ 20-72 Establishment.

C. Term of Office and Term Limits

  1. The Superintendent of Highways term of office, as elected by a majority of the Town of Brookhaven voters, shall be for four (4) years until the next required election date.
  2. The Superintendent of Highways may serve up to three four-year terms regardless of whether said terms are served consecutively or non-consecutively.

Article XII: Office of Receiver of Taxes

§ 20-69 Term Limits

The Receiver of Taxes may serve up to three four-year terms regardless of whether said terms are served consecutively or non-consecutively.

Text Amendment: Chapter 18A of the Code of the Town of Brookhaven entitled “Clerk” is hereby amended as follows:

§ 18A-1 Term of office.

Notwithstanding any provisions of § 24 of the Town Law or any other general, special or local law, the term of office of the Town Clerk of the Town of Brookhaven shall be four years. Such term of office shall commence on the first day of January next succeeding the next regular biennial Town election and shall apply to the Town Clerk elected in November 1981 and all Town Clerks elected thereafter.

§ 18A-2: Term Limit

The Town Clerk may serve up to three four-year terms regardless of whether said terms are served consecutively or non-consecutively.
