Non-Utility Highway Work Permit Procedures

  • Per General Municipal Law - 239-F No building permit shall be issued by any municipality to a property fronting on or has access to or be otherwise directly related to the County Right-of-Way without notifying the Suffolk County Commissioner of Public Works, Suffolk County will review and provide comments as necessary. The Local Municipality cannot issue a building Permit until Suffolk County provides 239-F approval. Therefore, the applicant must coordinate with the Town/Village Building Department to ensure SCDPW has received and approved the necessary 239-F paperwork before a Highway permit can be processed.
  • Per NYS Highway law § 136 All projects that have access or frontage proposing to make modifications within the County Right of Way (ROW) require a Highway Work Permit.
  • The zoning and subsequent use of this property is under the authority of the Town/Village in which this development is located. Thereby, the issuance of a Suffolk County “Highway Work Permit” should not be construed as an approval by this Department for any development and/or associated land use.
  • Permit Types: Our section will issue non-utility highway work permits for the following; New or modified access, temporary signs and banners, permanent signs, street lighting, test holes, monitoring wells and dewatering. Reference our Non-Utililty Permit application and instructions included in our Permit application package for more information.
  • Permit Fees: As per Suffolk County Law, Permit fees including Review, Impact and Security will be required, reference our General Conditions included in our Permit application package for more information.
  • Insurance: General Liability and Workers Compensation and Disability Insurance is required for all Permits, reference our General Conditions included in our Permit application package for more information.
  • All proposed work must meet the requirements of Suffolk County and the latest NYSDOT specifications and standards.
