Boundary Marking Requirements
After the completion of the 10-year review, ALP now requires standardized marking of lease site boundaries. To read more about this, please see Appendix B of the Revised Administrative Guidance.
Lease Site Corner marking requirements for new and renewed leases after the Ten Year Review (2021):
- All four corners of your operation must be marked with 6th Class Buoy with a minimum of three-foot surface expression (three feet above the water line)
- The corner markers are required to be yellow
- The corner markers must be radar reflective
- The corner markers must have reflective tape
Corner markers and all buoys present on the lease site premises must at minimum, buoys must be marked with “ALP” with your lease site # and your OBC permit number.
Language built into the lease agreement:
- Lessee shall have the right to place Equipment on or within the Premises, which is consistent with the purpose of shellfish cultivation, as permitted by the Federal and State regulatory agencies.
- No permanent structures shall be placed upon the Premises.
- Lessee shall install and mark all buoys, navigational aids and other equipment (as required or desired) at Lessee’s sole cost and expense. At minimum the Lessee shall mark and/or tag all equipment with the Lessee’s lease site identification number.
- All shellfish aquaculture equipment, temporary structures, and the contents thereof are the possessions of and responsibility of the Lessee.
As part of this new regulation, leaseholders are required to identify the boundaries of their lease site with 6th Class Buoys. Note: “Foam Buoys” and “Plastic Buoys” are likely the most relevant for use on ALP lease sites.
